Terms of Service

These Terms govern your use of Owlsignal, an analytics service operated by Zisomedia (a Dutch sole proprietorship; "we", "us"). By signing up or sending events to our SDK, you agree to these Terms.

1. The service

Owlsignal lets you instrument a game (or other software) with our SDK, send anonymous gameplay events to our backend, and view dashboards (funnels, retention, errors, sessions) for those events. The Free tier is provided as-is; paid tiers are governed by the additional terms in section 5.

2. Your account

  • You must be at least 16 years old (or 18 in jurisdictions that require it).
  • Each account is for one organization. You may invite team members under the seat limits of your tier.
  • You're responsible for keeping your password and API keys secret. Compromised API keys can be rotated from the dashboard at any time.

3. Acceptable use

You agree not to:

  • Send personally identifiable information (real names, emails, IPs, precise location, payment data, government IDs) through the SDK. Our schema is designed to discourage this; doing it anyway is a breach.
  • Use Owlsignal for tracking children under 13 without verified parental consent.
  • Attempt to deanonymize players, correlate hashes across customers, or build fingerprinting layers on top of the data we deliver.
  • Resell raw access to the API or dashboard without a separate written agreement.
  • Probe, scan, or attack the infrastructure outside of an agreed disclosure programme. Responsible disclosure: security@owlsignal.dev.

4. Your data

You retain all rights to the events you send and the configurations you create. We process them on your behalf as described in our Privacy Notice and the DPA. We may use aggregated, non-identifying usage statistics (e.g. "the average customer creates 3.2 funnels") to operate and improve the product; we do not use your event data to train AI models.

5. Plans, billing, usage limits

  • Plan prices, event limits, retention windows, and seat counts are listed on the pricing page. We may change pricing for new sign-ups at any time; existing subscriptions keep their current price for at least 90 days after notification.
  • Payments are billed monthly via Mollie (in EUR, VAT applied where required). Failed payments enter a 7-day grace period; after that, ingest is paused but data is retained per your previous tier for an additional 30 days.
  • When you exceed your monthly events budget, the ingest endpoint silently drops further events for that month and returns a non-error response. We do not page you or block your game. We'll email you at 80% and 100% of quota.
  • You may cancel any time. We do not pro-rate refunds for partial months.

6. Service availability

We aim for 99.5% monthly availability of the dashboard and 99.9% of the ingest endpoint. We don't offer a contractual SLA on the Free tier. Paid-tier SLA credits, if applicable, are described in your subscription confirmation.

Maintenance windows are announced at least 48 hours in advance via the in-app banner. Emergency security maintenance may happen without notice.

7. Termination

You may delete your account at any time from Settings. Upon deletion we erase your account data within 30 days, except where Dutch tax law requires us to retain invoices (7 years).

We may suspend or terminate accounts that breach these Terms — typically with prior notice, immediately for clear abuse (sending PII at scale, attacks on infrastructure, non-payment after grace period).

8. Liability

To the maximum extent permitted by Dutch law, our total liability for any claim relating to the service is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost players, lost revenue, or reputational harm.

The Free tier is provided without any warranty.

9. Governing law

These Terms are governed by Dutch law. Disputes are subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands, except where mandatory consumer-protection law gives you the right to your local courts.

10. Changes

We'll email you at least 30 days before material changes to these Terms take effect. Continued use after the effective date means you accept the new Terms; if you don't agree, cancel before the effective date.
